Not much longer. I’m sure Becerra will find his own ways to annoy us but at least he’s not trying to appeal to Ohio swing voters. That said, the way CA can pass things by a veto proof supermajority and the governor says no and everyone goes “ah well it’s September now, time for recess” is arrrgh.

I’m going to reset my position having thought about it a bit. It’s not just tech you’d be fighting with. It’s the entire business community. What you’re describing is really a confidentiality clause. And those are derigueur for settlement/severance agreements.

maybe, but we got victory on non-compete agreements in CA courts nonetheless, and that decision had few fans in industry

Even if the California legislature banned non-competes, I can't see it banning confidentiality clauses in settlement agreements. Think about who'd object: the California Medical Association, every insurer in the state, the plaintiffs' lawyers, the defense lawyers, the Chamber of Commerce...

...the California Judiciary, every business that has ever been sued, half of the businesses that have filed suit. Because banning confidential settlement agreements ends the settlement of claims both before and after litigation commences. The financial impact alone would be huge.
