California actually has a functional legislature, just saying.

How confident are you in its ability to resist lobbying from the entire tech industry? I’m not a Californian, so I don’t have a sense for that.

there would be a full court press, no doubt, but many legislators still owe their jobs to an electorate that feels less and less aligned with tech execs every day

Most of the legislative process is pretty forced into the open… but I’d be afraid of an unexplained last minute veto. If the bill spends no money that can only really come from the governor. Union support would help a lot in preventing that, I think. I dunno, I’m not a CA politics expert.

shame about the Governor

Not much longer. I’m sure Becerra will find his own ways to annoy us but at least he’s not trying to appeal to Ohio swing voters. That said, the way CA can pass things by a veto proof supermajority and the governor says no and everyone goes “ah well it’s September now, time for recess” is arrrgh.

I’m going to reset my position having thought about it a bit. It’s not just tech you’d be fighting with. It’s the entire business community. What you’re describing is really a confidentiality clause. And those are derigueur for settlement/severance agreements.

maybe, but we got victory on non-compete agreements in CA courts nonetheless, and that decision had few fans in industry

Even if the California legislature banned non-competes, I can't see it banning confidentiality clauses in settlement agreements. Think about who'd object: the California Medical Association, every insurer in the state, the plaintiffs' lawyers, the defense lawyers, the Chamber of Commerce...
