It kind of rocks to analyze laws as if you're the first person to consider it with any kind of nuance. Libertarians love to do this. Drunk driving a crime? What about people who handle their liquor better? Statutory rape? What if both parties are minors?

you're in general right. i was focusing on specifically enthusiastic consent and discussion around it, where it's generally considered only appropriate if it's not something you can just project on someone. body language is hellishly fraught that way, it's how you get "she was into it" excuses
